Banks Exotics — Terms of Service

These Terms of Service ("Terms") govern access to and use of the Banks Exotics content application and related services (the "App" or "Service") operated by Banks Elite LLC ("Banks Elite," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Banks Exotics is a brand operated by Banks Elite LLC. The App is a first-party tool that Banks Elite uses to prepare and publish its own promotional video content for the Banks Exotics luxury and exotic vehicle rental business to connected social media accounts, including TikTok via TikTok's Login Kit and Content Posting API.

2. Authorization to connect accounts

Only accounts owned or controlled by Banks Elite, or accounts whose owners have expressly authorized Banks Elite, may be connected to the App. By connecting an account, you represent that you are authorized to do so and to permit the App to upload content to it.

3. Acceptable use

You agree not to use the Service to: (a) violate any law or the terms, policies, or community guidelines of any connected platform, including TikTok; (b) upload content that is unlawful, infringing, deceptive, or harmful; (c) attempt to gain unauthorized access to the Service or its systems; or (d) interfere with the Service's operation.

4. Content

All Banks Exotics content published through the Service remains the property of Banks Elite or its licensors. You are responsible for ensuring that content you publish through the Service complies with applicable law and platform rules. Content uploaded to TikTok is additionally subject to TikTok's own terms and policies.

5. Third-party platforms

The Service integrates with third-party platforms such as TikTok. Your use of those platforms is governed by their respective terms and policies, and their availability and behavior are outside our control. We are not responsible for the acts, omissions, or availability of third-party platforms.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Banks Elite LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.

8. Termination

We may suspend or terminate access to the Service at any time. You may stop using the Service and disconnect any connected account at any time through that platform's settings.

9. Changes to these Terms

We may modify these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the United States and the state in which Banks Elite LLC is organized, without regard to conflict-of-laws principles.
